By accessing or using DirtDates ("the platform," "we," "us," or "our"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not access or use the platform.

These terms apply to all visitors, registered users, track promoters, advertisers, and any other party that interacts with DirtDates.

DirtDates is an informational and community platform for the dirt track racing community. It provides AI-assisted event discovery, track directories, schedule-building tools, race trip planning, community reviews, and related features for drivers, fans, sponsors, and vendors.

Important — AI-Generated Content Disclaimer: All race schedules, event details, purse information, track data, and editorial content on DirtDates are either AI-generated, user-submitted, or sourced from publicly available information. This content may be incomplete, inaccurate, or outdated. Always verify event details directly with official track and series websites before making travel plans, purchasing tickets, or committing resources. DirtDates is not responsible for decisions made based on information displayed on the platform.

You must be at least 13 years of age to use DirtDates. By using the platform, you represent and warrant that you meet this age requirement. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these terms on your behalf.

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Keep your account credentials secure and not share them with others
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these terms, engage in abusive behavior, or remain inactive for extended periods.

DirtDates allows users to submit content including track reviews, driver profiles, race results, schedule events, photos, and flags ("User Content").

License: By submitting User Content, you grant DirtDates a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, distribute, and promote that content on and in connection with the platform. You retain ownership of your content.

Accuracy: You are responsible for ensuring your submitted content is truthful, accurate, and not misleading. Submitting knowingly false race results, fabricated reviews, or fraudulent promoter information may result in account termination.

Moderation: All user-submitted content is subject to admin review. We reserve the right to approve, reject, modify, or remove any content at our discretion without notice.

Track promoters and event organizers may request featured placement, verified status, or promotional listings on DirtDates. By submitting a promoter profile or advertising inquiry, you represent that all submitted event and track information is accurate and you are authorized to represent the track or event in question.

Featured and promotional placements are subject to admin approval. DirtDates reserves the right to reject or remove any listing that contains inaccurate information, violates community standards, or is not in the best interest of the platform's users.

Promotional pricing, if and when introduced, will be communicated separately and governed by a separate agreement.

You agree not to:

• Post false, misleading, defamatory, or fraudulent content
• Submit fabricated race results, reviews, or track information
• Use the platform for unsolicited commercial solicitation or spam
• Attempt to access, probe, or compromise other users' accounts or platform systems
• Scrape, systematically download, or reproduce platform data without written permission
• Use automated bots or scripts to interact with the platform
• Interfere with or disrupt the integrity or performance of the platform
• Use the platform in any manner that violates applicable federal, state, or local law
• Harass, threaten, or demean other users

Violations may result in content removal, account suspension, or permanent ban at our sole discretion.

The DirtDates name, logo, platform design, and original content are the intellectual property of DirtDates and may not be reproduced, distributed, or used without written permission.

User-submitted content remains the property of the submitting user, subject to the license granted in the User-Generated Content section above.

Race results, track records, and official series data referenced on the platform remain the property of their respective owners. DirtDates does not claim ownership of third-party racing data.

DirtDates may contain links to third-party websites, track websites, or official series pages. These links are provided for convenience only. We have no control over and assume no responsibility for the content, privacy practices, or availability of external sites. Accessing third-party links is at your own risk.

DirtDates is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

• The platform will be uninterrupted, error-free, or secure
• Any event, track, schedule, or purse information is accurate, current, or complete
• AI-generated content reflects real-world events or conditions
• Results from using the platform will meet your expectations

Race schedules are subject to change, cancellation, or postponement at any time without notice. DirtDates is not liable for changes to events after information has been published on the platform.

To the fullest extent permitted by applicable law, DirtDates and its operators, owners, employees, and agents shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of revenue, profits, data, goodwill, or business opportunities
• Travel costs, hotel bookings, or other expenses incurred based on inaccurate event information displayed on the platform
• Damages arising from reliance on AI-generated or user-submitted content

In no event shall DirtDates' total liability to you for all claims exceed the greater of $50 USD or the amount you paid to DirtDates (if any) in the 12 months preceding the claim.

You agree to indemnify, defend, and hold harmless DirtDates and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the platform in violation of these terms; (b) your User Content; or (c) your violation of any applicable law or third-party rights.

We reserve the right to suspend or terminate your access to DirtDates at any time, with or without notice, for any violation of these terms or for any other reason at our discretion. Upon termination, your right to use the platform immediately ceases. Provisions of these terms that by their nature should survive termination shall survive.

We may update these Terms of Service at any time. When we make material changes, we will post the revised terms on this page and update the "Last updated" date. For registered users, we will provide notice via email or a platform notification at least 14 days before changes take effect. Continued use of DirtDates after the effective date constitutes acceptance of the revised terms.

These terms are governed by the laws of the United States. In the event of any dispute arising from these terms or your use of DirtDates, we ask that you first contact us at support@dirtdates.com to attempt good-faith resolution. If we cannot resolve the matter informally, disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

Nothing in this section prevents either party from seeking emergency relief to prevent irreparable harm.

These Terms of Service and our Privacy Policy constitute the entire agreement between you and DirtDates regarding your use of the platform and supersede all prior agreements, representations, or understandings.
